Controlling version
Mile Commons Platform Terms
English is the controlling version. The Chinese text below is a convenience translation.
1. Agreement and scope
These Terms are between you and BRIER SYSTEMS LLC, the operator of the Mile Commons platform. Mile Commons is the platform and brand. These Terms govern access to and use of the platform, including its public event information, runner accounts, registrations, community and volunteer coordination, organizer-managed spaces, and related communications.
When these Terms have an approved version and effective time, you agree to that version by taking the affirmative acceptance action shown during account creation or account remediation. Merely visiting a public page, signing in through an identity provider, receiving an email, or acknowledging a privacy notice is not Terms acceptance.
An event may have additional event-specific notices, participation rules, safety information, or waivers. Those materials are separate from these platform Terms and apply only when they are actually presented for that event.
2. Current pilot eligibility — adults only
During the current pilot, Mile Commons runner accounts and event registration through the platform are for adults only. Minors must not create or use a runner account or register through Mile Commons. This is the current pilot requirement, not a statement that the same age policy will necessarily apply to every future version of the service.
Mile Commons currently states this exclusion but does not collect a date of birth or independently verify age. Do not misrepresent your eligibility.
3. Accounts, registration information, and security
Provide accurate, current information requested for an account, registration, or community activity, and correct it when the available workflow permits. Do not create an account for another person, impersonate another person, or use a sign-in method you are not authorized to use.
You are responsible for reasonable care of the sign-in methods linked to your account and for activity performed through an authenticated session that you authorized. If a sign-in method may be compromised, stop using it and secure it with the identity provider. An account or verified email does not by itself grant organizer authority, membership, event entry, or access to protected resources.
4. Versioned Terms acceptance
Terms acceptance is tied to the exact displayed version. Mile Commons records the accepted version and acceptance time and preserves earlier acceptance records. Acceptance may not be inferred from OAuth authentication, a privacy acknowledgement, event registration, or silence.
If a later material version becomes current, Mile Commons may require a new affirmative acceptance before account activation or community actions continue. A stale, missing, or mismatched version does not activate an account.
5. Organizations, clubs, and community participation
Mile Commons supports isolated organizer and community workspaces, clubs, activities, and programs. Participation in one workspace, club, event, or program does not create membership, authority, access, or rights in another. Organizer and volunteer permissions are granted separately and may be limited by workspace, event, activity, assignment, and time.
Community participants must follow applicable organizer instructions and published community rules. Organizers are responsible for the event and program information they author, the permissions they grant, and their own interactions with participants. Mile Commons does not make one organizer, club, or participant the agent or representative of another.
6. Event information and registration
Mile Commons may publish organizer-provided event facts and may support registration, email verification, capacity limits, waitlists, attendance, cancellation, and event-linked access. A Mile Commons registration is for the identified Mile Commons or community program. It is not official entry into an external race and does not grant access to an event, venue, course, benefit, or protected resource unless the applicable organizer confirms it.
Submission of a registration request does not guarantee acceptance, availability, participation, placement, or any particular experience. Capacity, deadlines, eligibility, verification, withdrawal, cancellation, rescheduling, or organizer decisions may prevent or change participation. Use the available registration status and organizer-provided channel for the event concerned.
7. Official sources, safety, and reliance
External race entry, course, transportation, weather, public-safety, medical, venue, and other official or safety-critical information must be checked with the responsible race organizer, venue, government agency, emergency service, or other authoritative provider. Mile Commons links to those sources when appropriate but does not replace them.
Exercise your own judgment about health, fitness, conditions, equipment, travel, and participation. Follow official instructions and seek qualified professional or emergency help when needed. Do not rely on Mile Commons convenience content, community communications, or an old message for a safety-critical decision. Unless an event expressly states otherwise, do not assume that medical support, traffic control, road closure, insurance, equipment, or supervision is provided.
8. Volunteer and community activities
Volunteer and community roles are voluntary and assignment-specific. Volunteers must act only within the permission and instructions actually given, protect participant information, and promptly return or stop using access when the assignment ends. A volunteer label does not create general organizer authority.
Organizers remain responsible for deciding whether a volunteer role is appropriate, communicating the role, and coordinating the activity. Mile Commons does not guarantee that a volunteer, organizer, participant, route, activity, or event is suitable, trained, supervised, available, or safe.
9. User-submitted content and discussions
The service allows people with the relevant feature and permission to submit profile information, registration answers, event or activity information, operational notes, and communications. It does not currently provide a general public discussion forum. You remain responsible for what you submit and for having the rights and permissions needed to submit it. Do not submit unlawful, misleading, infringing, confidential, unsafe, harassing, or privacy-invasive material.
You retain any ownership rights you have in your content. You permit Mile Commons to host, process, reproduce, display, and deliver that content only as reasonably needed to operate, secure, and administer the platform and the relevant event or community activity. This operational permission is not an assignment of ownership. Mile Commons may restrict, remove, preserve, or disclose content when reasonably necessary to enforce these Terms, protect the service or people, comply with law, or respond to a documented incident.
10. Acceptable use and prohibited misuse
Use Mile Commons lawfully, respectfully, and only through authorized features and access.
- Do not impersonate others, misstate eligibility or authority, or submit information you are not authorized to provide.
- Do not harass, threaten, discriminate against, exploit, or endanger another person.
- Do not access or attempt to access another person’s account, private data, organizer surface, workspace, registration, token, or protected resource without permission.
- Do not introduce malware, evade safeguards or rate limits, scrape non-public information, interfere with availability, or test security without written authorization.
- Do not use the service for spam, fraud, unlawful promotion, rights infringement, or collection or disclosure of personal information without a valid purpose and permission.
11. Third-party services and external links
Mile Commons relies on or links to third-party services, which may include identity providers, hosting and database services, human-verification services, email delivery providers, organizer tools, official race sites, maps, and other authoritative sources. Their own terms and privacy practices may apply to your use of them.
Mile Commons does not control third-party availability, content, decisions, security, or changes. A link does not make Mile Commons the official source and does not guarantee that the destination remains current. For external race and safety-critical matters, the linked official organizer or provider remains authoritative.
12. Privacy notices are separate
Privacy notices and disclosures shown for an account, registration, or feature describe the information handled for that context. They are separate from these Terms. A privacy acknowledgement is not stored or treated as Terms acceptance, and accepting these Terms does not replace any privacy notice or any separate choice the service asks you to make.
Mile Commons publishes its platform Privacy Policy as a separate document. That Privacy Policy is not part of these Terms, it has no acceptance step, and reading or acknowledging it is not Terms acceptance. Event-specific privacy text remains limited to its stated event or feature and is not converted into a platform-wide policy by these Terms.
13. Intellectual property
Rights in the platform software, interface, Mile Commons branding, organizer materials, user content, and third-party materials remain with their respective owners. These Terms do not transfer ownership of your content to Mile Commons and do not transfer Mile Commons or third-party intellectual property to you.
You may use the platform and its materials only for their intended personal, event, community, or authorized organizer purposes. Do not remove ownership notices, falsely claim ownership, or copy, distribute, or exploit material beyond permission from the applicable rights holder or applicable law.
14. Suspension and termination
Mile Commons may restrict or suspend access when reasonably necessary to address a Terms violation, misuse, security or privacy risk, legal requirement, organizer-authority change, service failure, or risk to a person or the platform. Where practical and safe, Mile Commons may provide notice or a remediation path, but immediate action may be necessary.
You may stop using the service. Account closure, unlinking, or suspension does not require Mile Commons to erase records that must be retained for security, acceptance history, event operations, legal preservation, or another disclosed and authorized purpose.
15. Service changes and availability
Mile Commons may add, change, limit, pause, or discontinue features or content. The service may be unavailable or degraded because of maintenance, capacity, provider failure, security response, or circumstances outside Mile Commons’ control. No feature, event, account, registration, volunteer role, content item, or communication channel is guaranteed to remain available.
Mile Commons will not silently turn unavailable safety-critical content into an unofficial substitute. When an authoritative source or required control is unavailable, affected features may fail closed or be removed.
16. Disclaimers
To the fullest extent permitted by applicable law, the platform is provided on an “as is” and “as available” basis. Mile Commons does not promise uninterrupted or error-free operation or warrant that community, organizer, event, external, or convenience content is complete, current, accurate, suitable, or safe.
Mile Commons is not an official external race-registration system, medical provider, emergency service, insurer, transportation provider, or guarantor of an organizer or participant. Nothing on the platform is medical, legal, or other professional advice. Rights and warranties that applicable law does not allow to be excluded remain unaffected.
17. Limitation of liability
To the fullest extent permitted by applicable law, BRIER SYSTEMS LLC, as operator of Mile Commons, is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, goodwill, or data, arising from use of or inability to use the platform.
This draft does not propose a monetary liability cap. It does not exclude or limit liability that applicable law does not allow to be excluded or limited, including liability that may apply for fraud, willful misconduct, gross negligence, or death or personal injury.
18. Changes to these Terms
A material change creates a new version with its own effective time. Mile Commons may present the new version for review and require affirmative re-acceptance before an account remains active or community actions continue. Earlier versions and acceptance records are preserved rather than rewritten.
A version identifier must never be reused for different text or metadata. The current version and effective status will be displayed on the public Terms page once approved and activated.
19. Governing law and courts
New York law governs these Terms. New York courts have jurisdiction over disputes relating to these Terms or the platform, which will proceed through ordinary court proceedings.
20. Terms contact
General questions about these Terms may be sent to legal@milecommons.com. This address is approved only as the public contact for platform Terms and legal matters; these Terms do not designate it as a privacy, event-organizer, security, or support contact.
